Forcing every couple to pay for attorneys to get a prenup when they don’t always need or want the extra costs, time, or energy associated with them is just flat out wrong.
HelloPrenup allows you and your partner to add attorneys to your prenup process only if you require or prefer it.
Using HelloPrenup means creating your prenup, your way, without compromising on enforceability, budget, or timing.

In most states, you are not required to hire an attorney. However, in some states, attorney advice or representation is required for enforcement.
As of 11/1/24, the only statutory or caselaw-mandated requirements for having an attorney review and sign off on your prenup are if you:
- In California: Waiving or modifying spousal support.
- In Alabama: No matter what
- In South Carolina: No matter what
- In West Virginia: No matter what
- In New York: Adding Embryo Clauses
In many other cases where a prenup is being challenged, courts will look at whether or not you or your future spouse had the opportunity to obtain legal advice.
HelloPrenup covers this option for you by giving both you and your partner immediate access to our Independent Network of Partner Attorneys. If you and your partner choose to not use our attorneys, you will waive your right to counsel as part of your HelloPrenup agreement.

Attorney Support: Frequently Asked Questions
-
- Have any questions that aren’t mentioned here? We’re happy to chat.
Am I required to add attorney support?
It depends on your state. Some states, like Alabama, West Virginia, and South Carolina, require attorney involvement, while others, such as California, only require it specifically if addressing spousal support. New York only requires attorneys if you add in embryo disposition clauses.
Even if your state doesn’t require it, having attorney representation offers plenty of benefits. Not only can it increase the likelihood of the agreement holding up in court if challenged, but it also ensures you receive expert legal advice and a clear understanding of your rights and obligations.
Who needs Attorney Support?
Whether or not you need attorney representation varies from state to state. For instance, while Alabama, West Virginia, and South Carolina generally require attorney involvement, other states have different rules. In California, you’ll need an attorney only if your agreement addresses spousal support, while in New York, it’s necessary if you include clauses about embryo disposition. It’s important to understand the specific laws governing prenuptial agreements in your state to ensure your agreement is valid and enforceable.
Which attorney should I choose?
With HelloPrenup, choosing a lawyer for your prenuptial agreement is a straightforward and effective process. We start by understanding your specific needs and geographic location to provide you with a list of highly qualified lawyers in your area. You can review lawyers’ profiles and read reviews from other clients. Our platform simplifies the selection of a lawyer for your prenuptial agreement, providing you with all the tools and information you need to make the best decision.
What can a prenup attorney help me with?
Once you’ve created your prenup draft with HelloPrenup, your selected attorney can provide personalized legal guidance and support. They can answer your questions, suggest minor adjustments to the document, conduct a thorough review, and ultimately ensure your agreement is tailored to you and ready for signing.
How quickly can I get attorney support?
Very quickly! Most of our independent attorneys have next-day availability for an attorney representation call. Some even offer weekend availability. They are independent attorneys, so all of their calendars may differ. You must book your representation call after your prenup has been generated so the attorney may review your document before meeting.
What do other attorneys cost compared to HelloPrenup?
The cost of legal services, especially when it comes to crafting and signing prenuptial agreements, can vary significantly. Traditional legal routes may involve hiring an attorney whose fees can range from $2,000 to $20,000, which can be a considerable financial burden. In contrast,
HelloPrenup offers an accessible and cost-effective solution, with options to have a question-and-answer session with an attorney for just $49 or to have your prenuptial agreement reviewed, amended, and signed for only $699
This means that you can receive expert legal counsel and get your prenup in place without the exorbitant costs typically associated with traditional legal services. HelloPrenup aims to make the legal process fair, efficient, and financially manageable for all.
Do you offer attorney services? If so, how much does it cost to hire an attorney?
Yes, we offer attorney services in select states. You can purchase a 20-minute question and answer session (Q&A) if you’d like to have a telephonic consultation with an attorney in your state. Q&A sessions are a flat-rate of $49 per session, and there is no limit to the number of sessions you can purchase. Alternatively, you can purchase attorney representation if you’d like a more comprehensive option. Attorney representation includes a one-hour consultation, document review and customization, and attorney signature. Representation is a flat-rate of $699 per fiancé.
When can I purchase attorney services?
First, you’ll need to pay $599 to access the Questionnaire. Then, you and your fiancé can purchase a Q&A session or attorney representation under the Attorney Services section of the platform.
