Do I need to hire an attorney?

In most states, you are not required to hire an attorney. However, in some states, attorney advice or representation is required for enforcement.

As of 01/10/26, the only statutory or caselaw-mandated requirements for having an attorney review and sign off on your prenup are if you:

California: Independent legal counsel is required when a prenuptial agreement includes a waiver or limitation of spousal support. (Cal. Fam. Code § 1612(c))

New York: Each party must have separate legal representation when a prenuptial agreement addresses the disposition of embryos. (N.Y. Fam. Ct. Act § 581-306(a))

South Carolina: A prenuptial agreement excluding property from the marital estate is enforceable only if both parties were separately represented by counsel and provided full financial disclosure. (S.C. Code Ann. § 20-3-630(A)(4))

West Virginia: The state’s highest court has ruled that a prenuptial agreement is presumed valid only when both parties had independent legal counsel at the time of execution. Ware v. Ware, 224 W. Va. 599 (2009).

Who needs Attorney Representation?

For instance, while Alabama, West Virginia, and South Carolina generally require attorney involvement, other states have different rules. In California, you’ll need an attorney only if your agreement addresses spousal support, while in New York, it’s necessary if you include clauses about embryo disposition. It’s important to understand the specific laws governing prenuptial agreements in your state to ensure your agreement is valid and enforceable.

Is this legal?

Am I required to add attorney representation?

It depends on your state. Some states, like Alabama, West Virginia, and South Carolina, require attorney involvement, while others, such as California, only require it specifically if addressing spousal support. New York only requires attorneys if you add in embryo disposition clauses.

How quickly can I get Representation?

Very quickly! Most of our independent attorneys have next-day availability for an attorney representation call. Some even offer weekend availability. They are independent attorneys, so all of their calendars may differ. You must book your representation call after your prenup has been generated so the attorney may review your document before meeting. 

When do I start Representation?

You can purchase representation at any stage in the prenup process. However, scheduling an attorney meeting and conducting the representation session should happen after your prenup draft has been generated in the HelloPrenup platform. This allows the attorney to review the document before meeting with you. 

When do I pay for Representation?

You can pay for representation at any point during the prenup process. However, it’s best to make the payment once your prenup draft has been generated. After payment, you can schedule a meeting with an attorney to discuss the document, allowing them to review, suggest modifications if necessary, and sign the agreement.

Can one attorney represent both of us if we agree on everything?

No, unfortunately not. One attorney cannot represent both fiancés because it creates a conflict of interest.

Will the attorney review my prenup before my representation appointment?

Yes! If you purchase attorney representation, your attorney will review your generated prenup before your 1-hour consultation. During your consultation, you can discuss any questions you may have about the agreement and any desired customizations.

If my representation attorney needs to communicate with my fiancé’s representation attorney, will this increase the cost?

No, it will not! The attorney representation fee is a flat-fee, not an hourly rate. It includes three rounds of document revisions and communications with opposing counsel as necessary.

How much time does the attorney have to finish the revisions?

The average turnaround time is 3 business days. The typical range is between 1 and 7 business days. This timeframe can vary based on the level of requested edits that either fiancé may have for their respective attorneys.

If I hire representation, does my fiancé have to hire representation as well?

Not necessarily! Assuming you reside in a state that does not require attorney representation for both fiancés, one fiancé can hire an attorney and the other can decide to waive attorney representation.

Can I use attorneys outside of the HelloPrenup Partner Attorney Network?

If you require attorney services for an enforceable agreement, you must use HelloPrenup attorneys. Our platform does not allow external counsel to enter the platform without becoming a HelloPrenup Partner Attorney first. If you would like to work with outside counsel who is not in our network to finalize your HelloPrenup agreement, you’ll need to consider that before purchasing a prenup thorugh our platform.
