        “Wait, do I need an attorney for my prenup or not?”

        In most states, you are not required to hire an attorney. However, in some states, attorney advice or representation is required for enforcement.

        As of 1/10/26, the only statutory or caselaw-mandated requirements for having an attorney review and sign off on your prenup are:

        • California: Independent legal counsel is required when a prenuptial agreement includes a waiver or limitation of spousal support. (Cal. Fam. Code § 1612(c))
        • New York: Each party must have separate legal representation when a prenuptial agreement addresses the disposition of embryos. (N.Y. Fam. Ct. Act § 581-306(a))
        • South Carolina: A prenuptial agreement excluding property from the marital estate is enforceable only if both parties were separately represented by counsel and provided full financial disclosure. (S.C. Code Ann. § 20-3-630(A)(4))
        • West Virginia: The state’s highest court has ruled that a prenuptial agreement is presumed valid only when both parties had independent legal counsel at the time of execution. Ware v. Ware, 224 W. Va. 599 (2009).
        Important distinction: There are a handful of states that require waiver of counsel in place of legal representation, effectively requiring legal representation unless there is a waiver of counsel. This is why it’s always best practice to include a waiver of counsel block when skipping a lawyer for any state, just in case.

        Keep in mind that even if a state doesn’t strictly require lawyers for every prenup, a court may later decide—based on how the agreement was actually signed and negotiated—that independent legal representation was needed to enforce it.

        In many other cases where a prenup is being challenged, courts will look at whether or not you or your future spouse had the opportunity to obtain legal advice.

Q&A sessions are a flat-rate of $49 per session, and there is no limit to the number of sessions you can purchase. Alternatively, you can purchase attorney representation if you’d like a more comprehensive option. Attorney representation includes a one-hour consultation, document review and customization, and attorney signature. Representation is a flat-rate of $699 per fiancé.

                  When can I purchase attorney services?

                  First, you’ll need to pay $599 to access the Questionnaire. Then, you and your fiancé can purchase a Q&A session or attorney representation under the Attorney Services section of the platform.
