HERE'S WHY
Each state has its own laws that govern prenups
States govern what can and cannot be included in a prenuptial agreement, how it must be written and signed, and whether it will be enforced in court.
States differ on how property is divided
Some are community property states, others follow equitable distribution.
Spousal support rules are different between states
Some states allow waivers of alimony, while others limit or prohibit them.
Legal requirements and enforceability
Each state has specific rules about timing, disclosure, notarization, etc.
Every HelloPrenup prenup is created with enforceability in mind and covers your state's guidelines.

What state do I choose for my prenup?
Generally, the state a couple chooses for their prenup is the one they plan to live in as a married couple. This matters because each state has its own laws around enforceability, community property, alimony waivers, and waiting periods, and the state you select governs how your agreement holds up.
If you and your partner currently live in different states, you may choose the one where you intend to settle after marriage. Courts give the most weight to the state with the most significant connection to the marriage, including where you live, where the prenup was signed, and where you held the wedding.
When in doubt, you can ask an attorney directly in your HelloPrenup account.
FAQS
State-specific prenup questions
Why does my prenup need to be state-specific?
Each state has its own laws governing prenuptial agreements, including community property versus equitable distribution rules, spousal support waiver requirements, statutory waiting periods, and financial disclosure standards. A prenup that is valid in one state may not hold up in another. HelloPrenup builds your agreement to meet the specific laws of the state where you and your partner live.
What if my partner and I live in different states?
Most couples select the state where they plan to live after marriage or where they currently both reside most of the time. If you and your partner live in different states, you can use a choice-of-law clause to designate which state's law will govern the agreement. HelloPrenup walks you through this decision during setup.
What happens if I move states after signing my prenup?
A properly drafted prenuptial agreement remains valid even if you move to a different state. Most states honor prenups signed in another state under choice-of-law provisions, as long as the agreement does not violate the new state's public policy. Some states like California apply stricter scrutiny under their own laws, so an attorney consultation after a major move is a good idea.

Which state's law applies if we sign in one state and marry in another?
Generally, the state where you and your partner intend to live as a married couple is the most defensible choice for governing law. Courts often look to the state with the most significant connection to the marriage, including residency, where the prenup was signed, and where the marriage took place. Your HelloPrenup attorney can walk you through which state to designate.
Can I get a prenup if neither of us is a US resident?
HelloPrenup currently serves couples who plan to live in the United States. If you are marrying in the US or planning to move to a US state, you can use HelloPrenup to draft a prenup that meets that state's laws. For purely international prenups, consult an attorney in the relevant country.
