Limited Scope Attorney Services Agreement

If you purchase attorney services through the HelloPrenup website, this Limited Scope Attorney Representation Agreement will govern your relationship with the independent Attorney who will provide those services.

Introduction

HelloPrenup, Inc. (“HelloPrenup”) has arranged with independent attorneys to be available to assist HelloPrenup customers, for a separate and additional attorney fee, with limited scope legal advice and service (“Attorney Services”). If you purchase Attorney Services, this Limited Scope Attorney Representation Agreement (“Attorney Agreement”) will govern your relationship with the independent attorney (“Attorney”) who will provide the Attorney Services. Note that the individual Attorney who you retain may have their own retention agreement with additional terms (“Individual Attorney Agreement”). If there is a conflict between the terms of this Attorney Agreement and the Individual Attorney Agreement, the terms of the Attorney Agreement control.   

Your relationship with HelloPrenup is and shall remain governed by the HelloPrenup Terms of Use (including any applicable Service-Specific Terms) and the HelloPrenup Privacy Policy

Scope of Services

Q&A Session Service

If you have purchased this service, the Attorney that you have scheduled a call with will provide the following services:

      1. The Attorney will speak with you during one, time-limited 40-minute (or less) phone call as you fill out the HelloPrenup questionnaire, including answering questions about your specific situation, goals, and concerns.
      2. The Attorney will be available to explain the options available to you and make recommendations, including advice on how you may answer questions on the HelloPrenup questionnaire and/or supporting information that you have submitted for the Attorney’s review prior to your call.

The Attorney’s representation of you is limited to the services described above, and no more, and ends when the phone call ends.

Representation Session

If you have purchased this service, the Attorney that you have scheduled a call with will provide the following services:

    1. After you have generated your draft HelloPrenup agreement, the Attorney will speak with you during a single, scheduled phone call about your prenuptial agreement, the legal rights you are waiving, any edits you would like to make, as well as your goals and concerns and any recommendations they have.
    2.  During the call, the Attorney will be available to answer your questions about your prenuptial agreement draft, and any supporting documents that you may have submitted for the Attorney’s review prior to your scheduled call.
    3. In jurisdictions that require an attorney signature for a prenuptial agreement to be valid, or where your attorney believes an attorney signature will be valuable, this service includes the attorney signing your prenuptial agreement once you and your partner have agreed on all terms. NOTE: this service does not include the Attorney’s negotiation with your partner or your partner’s attorney over the prenuptial agreement’s terms.  

The Attorney’s representation of you is limited to the services described above, and no more and ends when the phone call ends. 

Independence

Each Attorney is an independent practitioner and not an employee of HelloPrenup. The Attorney will exercise the Attorney’s independent legal judgment, without interference, influence, or control by HelloPrenup, Inc. 

Attorney Compensation

The entire fee you pay when you purchase a HelloPrenup Attorney Service will be remitted directly to the Attorney by HelloPrenup (the “Flat Fee”). Once paid, all or any part of the Flat Fee becomes the property of the Attorney and will not be placed in a trust account. However, the fact that you have paid in advance does not affect your right to terminate the attorney-client relationship. If your relationship with the Attorney is terminated before the Attorney Services have been provided, you may or may not have a right to a refund of all or a portion of the amount of the Flat Fee from the Attorney.

Any disputes, concerns, or issues regarding the Attorney Services, quality, fulfillment, or fees must be addressed and resolved directly with the Attorney. You agree that HelloPrenup shall bear no responsibility or liability concerning such disputes, and any claims or disputes related in any way to the Attorney Services shall be exclusively between you and the Attorney.

Your Consent Regarding Attorney Communications

You expressly grant HelloPrenup permission to receive, store, forward, and review communications between you and the Attorney, solely to facilitate those communications and the Attorney Services provided under this Attorney Agreement. HelloPrenup has agreed to keep such communications confidential to at least the same extent as required by the Attorney under the laws and rules governing the Attorney’s communications with you. To the extent any provision of this Attorney Agreement conflicts with any provision of the Privacy Policy, the provision of this Attorney Agreement controls.

Your Acknowledgments and Agreement

      1. You have read and understand this Attorney Agreement.
      2. The Attorney will rely entirely on the facts, information, and documents you provide. The Attorney will not make any independent investigation of your facts or information or the authenticity of any documents you provide. It is therefore extremely important that you are completely truthful as to any information you provide.
      3. The Attorney is not promising you any specific favorable result in the future. 
      4. The Attorney Services described above in the section titled “Scope of Representation” are the only legal services to be provided by the Attorney.  The Attorney is not required to provide you with any additional legal assistance or representation in this or other legal matters.
      5. The Attorney’s representation of you ends when the services described above have been completed or the attorney-client relationship is terminated, whichever comes first.
