A “Blank Space” to sign a prenup? With the Taylor and Travis romance heating up over Super Bowl weekend, we thought we’d take a hypothetical tour through their potential prenuptial agreement. While Taylor needs no introduction, she is one of the most legendary pop stars in the world and one of the only musicians who has made her billions off music alone. Travis is another legend in the sports world. He’s the famous tight-end on the Chiefs (who are in their Dynasty *Era*). Whether you’re a billionaire pop star or a regular joe—getting a prenup is something to consider. They can protect assets, align couples on financial goals, and create transparency between a couple. So, without further ado, let’s get into all things T. Swift, Travis, and their hypothetical prenuptial agreement.
Prenup basics
First, what is a prenup? It’s a contract between two lovebirds (much like Travis and Taylor) who outline their financial obligations, ownership, and responsibilities prior to the wedding day. Wealthy people like these two typically enter into prenups to protect assets in the event of a divorce, such as protecting Tay’s expansive real estate portfolio, but prenups can also do so much more.
Prenups can also create financial transparency between the couple because full financial disclosure is required (the sharing of income, assets, and debts). For example, Travis and Taylor would literally need to provide one another with a financial schedule detailing out each and every one of their income streams, assets, debts, and potential future inheritances. We’re sure it will be quite the financial schedule!
Another reason people enter into prenups is to align on future goals. For example, Tay and Trav could use a prenup to align on future business plans together, what retirement would look like, how future purchases together would be treated, etc.
Hypothetical clauses Taylor & Travis might use
Let’s explore the possibilities for Tay and Trav’s prenuptial agreement—we’re talking about what clauses they might include in theirs. Here’s what we’d guess:
Protecting premarital assets
Let’s face it, Taylor is worth is approximately $1.1 billion. Travis’ net worth sits around $90 million. As you can imagine, Tay has a lot of premarital assets—from music royalties to her Eras Tour earnings to her impressive real estate portfolio. Then there is Trav’s growing portfolio of NFL checks, podcast income, and sponsorships. Making sure all of these assets stay with the respective owner is likely to be a main component of their prenup.
Future earnings
What’s also likely to make an appearance in their prenup is future earnings. They’re both in the prime of their careers, so the best is yet to come. It’s likely that they will outline how future acquired assets will be treated both during the marriage and in the event of a divorce.
Debt ownership
The ownership of debt will be an important topic, as well. Either person may take out debt to start a business which, as you can guess, could likely get pretty large. Making sure debt stays with the respective owner, even if no debt is ever taken out, will be crucial.
Confidentiality
This is a big one, especially for two of the biggest names on the planet. A confidentiality clause in a prenup is effectively like an NDA. While they might already have an NDA in place (lots of celeb couples do this now), it will be important to reiterate it in their prenup. This clause will likely include a restriction on tell-all books, podcasts, etc., for both during the marriage and in the event of a divorce.
Intellectual property, image, and brand
Taylor will likely want to outline her intellectual property (cough, cough, her music) as separate property. Any music she makes during the marriage will be especially important to protect. In addition, both parties have images and brands for which they may want to outline protections.
Social media clauses
Some people, even regular folks, include clauses about social media use—such as not allowing either party to disparage the other on social media, either during the marriage or in the event of a divorce. If one party disparages the other on social media, they will owe the innocent party a lump sum of money.
Choice of law
The law that governs the prenup will be an important aspect of the agreement. Typically, this is a pretty straightforward answer for most people—you choose the state in which you will reside as a married couple. However, with Taylor’s homes all across the US and Travis’ home in Kansas City, it’s unclear where their main residence is.
Embryo disposition
A relatively new aspect of prenups is determining embryo disposition—deciding who gets to keep embryos in the event Travis and Taylor have to go through IVF and then ultimately get divorced. For example, if Tay and Trav decide to go through IVF, perhaps for the use of a surrogate, then they would need to create embryos. Sometimes, couples can end up making a lot of embryos—more than they actually end up using. If T&T gets a divorce, they might want to decide in a prenup who gets to keep those embryos.
The bottom line on Swift & Kelce’s prenup love story
As you can see, prenups do more than just protect assets—they create financial transparency and align couples on goals. Tay and Trav have a lot more assets to protect than the average couple, so they’ll definitely want to consider a prenup for that reason. However, getting a prenup can also help them understand each person’s financial landscape (a peak under the hood). They can also get aligned on future goals—whether it’s a joint business venture or their eventual retirement.
We guess that they’ll have a lot of the standard prenup clauses, like keeping premarital assets separate and making sure debt stays with the appropriate owner. However, they may also have celebrity-focused clauses, like protecting brand and image. And remember, this is totally a hypothetical exploration into their potential prenup!
